ONLINE STORE REGULATIONS
TrickandChic Used Fashion
§ 1. General Provisions
1.1. These Regulations define the rules for using the TrickandChic Used Fashion Online Store, operating at www.trickandchic.pl, including the rules for placing
orders, concluding sales contracts, deliveries, lodging complaints, and withdrawing from the contract.
1.2. The Seller and owner of the Store is Beata Kielban, operating an unregistered business within the meaning of Article 5 of the Act of March 6, 2018 - Entrepreneurs' Law.

1.4. All goods offered in the Store are used items (clothing, books), free from legal defects, legally introduced to the Polish market.
1.5. The Customer is obliged to familiarize themselves with these Regulations before placing an order.
§ 2. Specifics of Used Goods
2.1. The subject of sale in the Store are second-hand goods (used clothing and used books).
2.2. Goods may show natural signs of use, resulting from their previous purpose (e.g., creases, minor pilling of fabrics, bent pages or covers, slight discoloration).
2.3. The Seller undertakes to truthfully describe the condition of each item in the product card and present any specific defects (e.g., stain, damaged zipper, missing page) in the description or on photos.
§ 3. Placing Orders and Prices
3.1. Prices given in the Store are expressed in Polish zlotys (PLN). The Seller is exempt from VAT (tax-exempt sales based on Article 113 paragraphs 1 and 9 of the VAT Act).
3.2. Orders can be placed 24 hours a day, 7 days a week via the form or order system on the Store's website.
3.3. To place an order, the Customer selects the goods, provides data necessary for shipping, and chooses the payment and delivery method.
3.4. The sales contract is concluded upon confirmation of acceptance of the order for processing by the Seller via electronic means (email or a message in the sales system sent to the customer).
§ 4. Payments and Delivery
4.1. The Customer can choose from the following payment methods:
● Fast online payments / BLIK;
● Traditional bank transfer to the Seller's account.
4.2. The deadline for paying for the order is 3 calendar days from the date of concluding the contract. After this period, an unpaid order will be canceled.
4.3. Delivery is carried out within the territory of the Republic of Poland via selected operators (e.g., InPost Parcel Lockers, courier).
4.4. The cost of delivery is covered by the Buyer, and its amount is indicated during the order placement.
4.5. The order processing time (assembly and handover of the shipment to the carrier) is 1 to 3 business days from the date of payment posting.
§ 5. Right of Withdrawal from the Contract (Returns)
5.1. The Consumer has the right to withdraw from the sales contract without giving any reason within 14 days from the day the Consumer or a third party indicated by him takes possession of the goods.
5.2. To exercise the right of withdrawal, the Consumer is obliged to inform the Seller of their decision via email or in writing.
5.3. The Consumer sends the returned goods to the address provided by the Seller immediately, but no later than 14 days from the day they withdrew from the contract.
5.4. The direct costs of returning the goods (sending the shipment back) are borne by the Consumer.
5.5. The Seller shall refund payments using the same payment method as used by the Consumer, within 14 days from the day of receiving the statement of withdrawal from the contract (the Seller may withhold the refund until the item is received).
5.6. The Consumer is responsible for any diminished value of the goods resulting from using them in a manner exceeding what is necessary to ascertain the nature, characteristics, and functioning of the goods.
§ 6. Complaints and Non-conformity of Goods with the Contract
6.1. The Seller is obliged to deliver goods in conformity with the contract.
6.2. Pursuant to Article 43b paragraph 2 of the Consumer Rights Act, with regard to used goods, the Seller's liability for non-conformity of the goods with the contract is shortened to 1 year from the date of delivery of the goods to the Consumer.
6.3. The Seller is not responsible for the non-conformity of the goods with the contract regarding defects, signs of use, or features about which the Consumer was explicitly informed in the product description or on photos before making the purchase.
6.4. Complaints can be submitted to the Seller's email address. The notification should include a description of the defect, the date of its discovery, and the Customer's request.
6.5. The Seller will process the complaint within 14 days from the date of its receipt.
§ 7. Personal Data Protection (GDPR)
7.1. The administrator of Customers' personal data is Beata Kielban, operating the TrickandChic Used Fashion Store.
7.2. Personal data is processed solely for the purpose of fulfilling orders, handling complaints, and potentially pursuing claims, in accordance with the Store's Privacy Policy.
§ 8. Final Provisions
8.1. These Regulations come into force on the date of publication on the Store's website.
8.2. The Seller reserves the right to amend the Regulations. Changes do not affect orders
placed before their effective date.
